Kern Smart Remote Service (SRS)

The service Kern Smart Remote Service (hereinafter referred to as SRS) is offered by Kern Microtechnik GmbH (hereinafter referred to as Kern) and enables the customer to quickly detect and rectify errors in the event of standstill or problems with his Kern machines. The live image of the TNC control and the machine transmitted by the customer is evaluated by a Kern service employee. The subsequent troubleshooting shall take place under the guidance of the service technician, insofar as this is technically possible.

Should individual provisions of this user agreement be invalid or become invalid after conclusion of the contract, the validity of the rest of the contract shall remain unaffected. In place of the invalid/void provision, the parties shall agree on a provision that comes as close as possible to the purpose intended by the invalid/void provision. This shall also apply to the filling of any gaps in the contract.

For reasons of better readability, the masculine form is used for personal designations and personal nouns in this user agreement. Cooperation and technical assistance of the customer

1. The customer undertakes to support the Kern service technician in the use of the SRS at his own expense and within the scope of his personnel possibilities. This also applies if work is to be carried out that is not reasonable for a single person and/or can be carried out in compliance with the necessary work safety regulations.

2. The customer undertakes to provide the technical staff and assistants in accordance with the planned activities, as well as all necessary aids, internet access, electricity, compressed air and water, including the connections required for this purpose.

3. The installations must, depending on the work to be carried out, be equipped with the necessary safety equipment. Depending on the scope of the assignment, the systems must be partially or completely shut down for the planned duration and are fully available to the Kern service technician during this time. The customer is obliged to create a complete backup of the entire machine and control system before the start of the deployment and, if necessary, to provide Kern with this backup. If the customer fails to do so, Kern shall not be liable for the recovery of such data that has been lost as a result of improper backup.

4. Changes made by the customer to the equipment or the technical environment, insofar as they could have an effect on the SRS, must be notified in advance and agreed with the Kern service technician.

5. Additional maintenance expenses, which are determined in the course of the SRS, will be offered subsequently by Kern at cost.

Data protection

1. Personal data

Personal data is only processed by Kern and made accessible to employees of Kern to the extent that this is necessary for the documentation and traceability of the SRS use requested by the customer and, if applicable, corresponding follow-up activities. 2. Data transfers

The software and the IT infrastructure of the SRS are operated by an external service provider. The personal data collected when accessing these files is stored on the service provider's servers. The provider will only process the stored data to the extent necessary to fulfil its service obligations and will comply with the instructions by Kern regarding this data. In order to ensure data protection-compliant processing, the service provider is contractually bound to a correspondingly defined order processing. The SRS applications use SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as enquiries that you send to us as the operator of the SRS applications. If SSL or TLS encryption is activated, the data you transmit to us cannot be read or viewed by third parties. 3.

3. storage of communication and content data of the SRS applications

Communication with the Kern service technician is treated confidentially. A history of the connection(s) with

  • Start and end time of the communication,
  • exchanged notes and documents,
  • documented chat content including translations made ("voice-to-speech" conversion),

is stored for billing purposes for a period of 5 years and assigned to the respective business customer. If there is a personal reference, the data is processed primarily for billing purposes for the fulfilment of the concluded service; the legal basis is accordingly Art. 6 para. 1 lit. b) DSGVO. In addition, Kern Microtechnik GmbH has a legitimate interest in storing service-related communication and content data. This results from the improvement of our service quality, the reduction of the administrative effort as well as the improved control of the communication with the service technicians. Accordingly, the legal basis is Art. 6 para. 1 lit. f) DSGVO.

The customer must ensure that all persons recorded by the video have consented to the recording and use.

Liability

1. Kern SRS is an advisory service - the decision to carry out actions and work steps as well as the responsibility for the consequences of these activities lies with the respective person carrying them out.

2. Kern is not liable for any damage to the relevant systems and their accessories, as well as to life and limb, which may occur as a result of carrying out the actions and work steps. The customer must ensure that the person(s) carrying out the work have the necessary training and/or skills to do so.

3. If a planned Kern SRS assignment cannot be carried out due to unplanned events over which Kern has no influence (e.g. illness of an employee, force majeure), the customer has no right to charge the costs for operating resources, aids, employees or service providers provided.

Other information

1. If the customer requests the activities and executions outside the Kern business hours, insofar as Kern agrees to this, the customer shall bear the associated additional costs.

2. This agreement is based on the Kern standard hardware and software solutions for the use of the SRS. Further or customer-specific solutions are to be evaluated separately with regard to organisation, technology and costs.

3. The contractually agreed warranty remains unaffected by this usage agreement.

Rights of the data subject

In accordance with the statutory provisions, you are entitled to receive information at any time about your personal data stored by us and how it is processed. You have a right to correction, restriction of data processing, blocking or deletion of this personal data. You can object to the processing of your data at any time with effect for the future

You have the right to revoke a voluntary consent to the processing of personal data at any time, without the lawfulness of the processing of your personal data carried out to date on the basis of your consent being affected by the revocation.

We will comply with these requests without delay, but in doing so we must observe any applicable statutory retention requirements, objection periods, assertion, exercise or defence of legal claims.
